7 Successful Mediations today 04.12.2017

1. Civil suit for declaration and permanent injunction referred by Judge Albasit Mudassir Ali, Learned Civil Judge Sargodha. Titled as Shamim vs Muhammad Asif etc.
Suit dismissed as withdrawn after conducting oath on Holy Quran at ADR Center Today as agreed between the parties. Parties were nephew and aunt. Aunt agreed that she will relinquish her claim in the suit if another of his nephews takes oath on Holy Quran that she does not have any right towards the disputed land. The other nephew namely Rana Dilawar took oath which was agreed by Shamim Bibi and she withdrew her suit today.

2. Application for Hizanat referred by Judge Adnan Anjum Gondal, Learned Family Judge, Sillanwali-Sargodha titled as Muhammad Imran vs Khatoon Bibi. Couple reconciled to live together the house near parental house of wife for a better future of their children. . Application dismissed as withdrawn.

3. Four cases referred by Judge Shamas Hasnain Khan Sial, Learned Civil Judge-Judicial Magistrate-30 Shahpur-Sargodha. Titled as :

         i. Khaliqdad etc vs Rabnawaz etc. Application to make the award rule of court.

        ii. Khaliqdad etc vs Rabnawaz etc. Suit for declaration and Permanent Injunction.

        iii. The State vs Khaliqdad etc. FIR No. 211/17 Police Station Shahpur Saddar.

        iv. The state vs Muhammad Mumtaz etc. Cross Version of above FIR.

Four cases were between the same parties who were real brothers having chronic litigation. Their mother was with elder brother. They reconciled and forgave each other. Younger brother sought forgiven from mother and elder brother in front of me today. They hugged each other after six years and cried along with their mother. In Criminal trials-Accused acquitted while civil cases dismissed as withdrawn.

4. Family suit referred by Judge Naviza Abbas learned Judge Family Court Sargodha titled as Noreen Akhtar Vs Khalid Pervez. Marriage between the parties was already dissolved through Divorce by husband. They had one daughter. Suit was for Maintenance and delivery expenses. Amount of past maintenance and delivery expenses was agreed between the parties at Rs. 67500/-. While future maintenance at the rate of Rs. 2500/- per month with ten percent annual increase was also agreed. Suit decreed.
