5 Successful Mediations today 04.01.2018

Inherittance Issue-Brother and Sister:

1. Petition under Section 12(2) of Code of Civil Procedure, 1908 referred by Judge Shamas Hasnain Khan Sial Learned Civil Judge Shahpur-Sargodha titled as Muhammad Saeed etc vs Muhammad Feroz etc. 

2. A Civil Suit for Declaration and Permanent Injunction referred by Judge Muhammad Imran Jaffery Learned Civil Judge Shahpur-Sargodha titled as Muhammad Saeed etc vs Muhammad Feroz etc. 

Both the above suit and petition were on the dispute of property inherited by a brother and sister. Sister had already expired. Her children were proceeding with the cases. Today the brother Muhammad Feroz agreed to give share to the children of his demised sister as per their demand. As parties agreed on the same thing, suit decreed. 

Land Dispute between the members of a family:

3. A civil suit for partition of immovable property referred by Judge Muhammad Imran Jaffery Learned Civil Judge Shahpur-Sargodha titled as Muhammad Feroz etc vs Muhammad Mazhar etc. 

4. A civil suit for Declaration and Permanent injunction referred by Judge Muhammad Imran Jaffery  Learned Civil Judge Shahpur-Sargodha titled as Muhammad Mazhar etc vs Muhammad Feroz etc.  

5. A civil suit for Declaration and Permanent injunction referred by Judge Muhammad Imran Jaffery  Learned Civil Judge Shahpur-Sargodha titled as Hassan Abbas etc vs Muhammad Feroz etc. 

These three civil suits were between the members of same family. Each member had inheritted 129 Kanals of land from their father. Some portions of land were precious due to price hike with passage of time and provision of utilities. They were in dispute for more than a decade. Parties agreed on one scheme for partition of land and exclusion of residential houses, deras and land which has been sold by them. Suits decreed.
